Budsies Art Contest

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. 

1.  Eligibility

The Budsies Art Contest is open to children This contest is open to budding artists of all ages. If you're under 13, a grown-up (parent or guardian) needs to help you submit your entry. Employees of Budsies PR LLC and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members (those who share the same residence at least three (3) months a year whether or not related) of each such employee are not eligible to win.

2. Sponsored

The Sweepstakes is sponsored and operated by Budsies PR LLC (“Sponsor”), located at 1700 Depot Ave, Suite 7, Delray Beach, FL 33444. 

3.  Agreement to Official Rules

Participation and entrance in the contest constitutes entrant's full and unconditional agreement and acceptance to be bound by the Official Rules and the decisions of the Sponsor, which are final and binding. Winning a Prize (as defined herein) is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. 

4.  Contest Period

The Contest period begins June 13, 2024 at 8am EST. and ends on June 30th, 2024 at 12pm EST. 

5.  How to Enter

• Upload an image of your art

• Enter the name of the artist

• Enter your email address

• Enter the art contest

Qualifying entries (each an “Entry” and collectively referred to herein as “Entries”):

• Must be associated with a valid email address

• Artwork must be done by the person entering the Contest

• Image must clearly show the artwork (grainy, out of focus, or photos showing only a part of the animal are not qualifying Entries)

6.  Voting

Voters may cast one vote per day for the duration of the contest.

Photograph Guidelines:

(a)     Photos cannot contain any content providing personally identifiable information about yourself or any third parties, such as last name, address, phone number or any contact information;

(b)    Photos cannot contain content portraying or referring to people or characters from movies/shows, video games, etc.;

(c)     Photos cannot contain any content in violation of third-party rights including, but not limited to: copyrights, trademark, right of publicity or any other proprietary rights; 

(d)    Photos cannot contain any content (i) that is libelous, defamatory, disparaging or tortious;  (ii) that is pornographic, adult-oriented or sexually-explicit; (iii) portraying or referring to lotteries or gambling; (iv) portraying or including explicit or offensive language; (v) portraying or advocating discrimination; and (vi) portraying or advocating tobacco, alcohol or drugs;

(e)    Photos cannot contain content that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any basis protected by federal, state, or local law, ordinance, or regulation; and

(f)      Photos cannot contain content that (i) denigrates, disparages or reflects negatively on the Sponsor(s), their products or employees, or on any other person, company, product or service, and (ii) is in violation of any law or regulation.

If a photo of the art does not comply with the requirements listed above or includes any of the prohibited elements listed above, the photo will be disqualified, along with the entrant who submitted it. The above list is not intended to be exhaustive; Sponsor may disqualify any photo if it contains content that Sponsor deems, in its sole discretion, to be inappropriate, offensive or obscene in any way or to not be in compliance with these Official Rules.

By submitting a photo of artwork, you hereby represent and warrant that:  (a)  your photo is original and owned by you;  (b)  you have not included any restricted content in the photo and have not violated any of the requirements listed herein, and;  (c)  you consent to the submission and the use of the photo.

6.  Winner Selection

The qualified photo with the most votes from a U.S. resident wins the Grand Prize. If a winner is unwilling/unable to comply with these Official Rules, winner will be disqualified and an alternate may be selected. Sponsor is not obligated to notify you if your Entry is disqualified. The odds of winning may depend on the total number of eligible Entries received.

In the event a specific Reach Goal is triggered, additional Category Winners will be selected by Budsies PR LLC at its sole discretion.

Superlatives winners will be considered based upon the following criteria: (a) quality of image, (b) how well submitted image relates to particular category. Judging will be conducted by a panel of Budsies PR LLC employees at its sole discretion (the “Panel”). The Panel will evaluate all valid entries and pick the winners.

This Contest is subject to all applicable federal, state, local and municipal laws and regulations.

7.  Notification of Winner(s)

The winner(s) will be chosen on or before July 7, 2023 at 12pm EST. We will contact the winner(s) on or about seven (7) days following July 1, 2023, via email and display the winners on the contest page. Upon verification of eligibility and winner’s shipping address, Sponsor will begin production and delivery of the Prize, which may take approximately five (5) to ten (10) weeks depending on current turnaround times. Notified winners have ninety (90) days to confirm their shipping address and claim their Prize. Unclaimed Prizes are forfeited. 

8.  Prizes (each a “Prize” and collectively referred to herein as “Prizes”)

Budsies plush will be made only to match the photo originally submitted to the contest. Not redeemable for any other photos. 

REACH GOALS

The Prizes will increase based on the total number of contest entrants

500+ Contest Entrants

In addition to the Grand Prize winner, there will be 3 additional Category Winners (4 total Prize winners). Each superlative winner (if applicable) will receive the following Prize:

One (1) 16” Budsies stuffed animal, including shipping to the continental U.S. If shipping to an address outside of the continental U.S. the winner is responsible for associated shipping and custom fees. Approximate retail value (“ARV”) of Prize is $149.

Budsies plush will be made only to match the photo originally submitted to the contest. Not redeemable for any other art photos. 

Approximate retail value (“ARV”) of all Prizes if superlatives are selected: Approx. $800

The Prize is non-refundable, non-transferable, and not exchangeable for cash, credit or any other item. Sponsor reserves the right to substitute a Prize for one of equal or greater value for any reason. All winners shall accept Prizes as they are and subject to any terms and conditions of said Prize.  All Prizes will be awarded provided a sufficient number of eligible Entries are received. Winners shall be solely responsible for any tax liability as a result of receiving a Prize.  

International Entrants: Please note that you are responsible for your country’s local duties/tariffs when receiving the Budsies. It is up to you if you would like to proceed with making it. If so, these fees will be your responsibility. 

9.  Right to Amend/Cancel

The Sponsor reserves the right to cancel or amend the Contest and these Official Rules without prior notice in any event deemed to be outside of the Sponsor’s control. Any changes to the Contest will be notified to entrants as soon as possible by the Sponsor via the contest landing page. 

10.  Unreceived Entries

No responsibility can be accepted by the Sponsor for Entries not received for whatever reason.

11.  Technical Difficulties

Sponsor is not responsible for any problems or technical malfunction or error of any kind. If the Contest is not capable of running as planned for any reasons including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right in its sole discretion, without prior notice, to cancel or modify the Contest.

11.  Publicity

By participating, each entrant grants Sponsor permission to use his/her name, photo, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law. 

12.   Ownership of the Entry

By entering the Contest, you represent and warrant that you are the rightful owner of your artwork shown in the photograph submitted.

You give a non-exclusive license to the Entries to the Sponsor for promotional purposes. Entries will not be acknowledged or returned.

By providing your email address, Sponsor may email you company updates, special offers, announcements and other promotional material. You can unsubscribe at any time. Entrants email addresses are subject to Privacy Policy listed at privacy.budsies.com

12.  Social Media Release

This Contest is NOT ENDORSED BY FACEBOOK, TWITTER, PINTEREST, INSTAGRAM, or any other social media sites (“Social Media Sites”): By participating in this Contest, you acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Pinterest, Instagram, or any other social media site/platform and release the aforementioned Social Media Sites from any and all liability arising from or related to this Contest. Any questions, comments or complaints regarding the promotion will be directed to the Sponsor, not the aforementioned Social Media Sites.

13.  Legal

To the fullest extent permitted by law, you also agree to release Sponsor and their respective employees, affiliates and agents from any and all liability, loss, damage or injury by or to any person in connection with the Contest. Sponsor does not make any representation, warranty or guarantee, express or implied, relating to the Contest or the Prizes.

The Contest shall be governed by and construed in accordance with the laws of the State of Florida, without giving affect to any choice of law or conflict of law rules or provisions. Any legal claim arising out of the Contest must be brought in state or federal court located in Palm Beach County, Florida.  Any and all disputes, claims and causes of action arising out of or connected with this Contest, or any Prize awarded shall be resolved individually, without resort to any form of class action.
